RainMaker Provides Terrorist Searching
Accepting Fees from Persons Suspected of Aiding Terrorists can Lead to Fines and Imprisonment

government agencies, announced that it will provide terrorist searching capabilities as part
of its Gold and Platinum .NET Practice Management systems.
RainMaker’s Platinum product, powered by Microsoft® .NET technology, consolidates the

information, people, systems and devices, enables RainMaker Platinum to deliver enhanced
capability allowing clients to share and integrate critical information quickly and efficiently.
The U.S. Treasury Department's Office of Foreign Asset Control (OFAC) prohibits attorneys
from accepting fees from any individual or organization shown on the Specifically Designated
Nationals (SDN) list. Failure to comply with OFAC regulations can result in a $1 million fine if
unintentional and up to $10 million, along with 10 - 30 years incarceration if intentional. According to a recent ABA publication, “If the client is listed, the attorney may collect fees from
the client only if and when OFAC grants a specific license. … OFAC has already initiated actions
against attorneys and law firms for failing to comply with the regulations.” The SDN list includes
persons suspected of aiding terrorists, as well as narcotic traffickers and countries subject to U.S.
embargoes.
“Searching for terrorists may not quite be as easy as it seems. Names that appear to be common
company names may appear on the list. The SDN list further complicates the search process by
including a number of alias' for many people, ” said James Hammond, president of RainMaker
Software. “We believe that firms should be aware of their requirements under OFAC. Our
conflict search engine with its phonetic and fuzzy logic search capabilities will assist the firm in
finding names that may be shown on the list.”
The RainMaker system will allow the firm to download new SDN lists from the Treasury
Department's website and import them into a special conflict OFAC table in Practice
Management. Since the SDN list is periodically updated, OFAC allows a firm to subscribe to a
notification service that alerts the firm when a new list is available for downloading. Routine
updates to the SDN list include both additions and deletions.
